The "Service Contract - Designer" is a basic template for establishing a contract between an artistic designer hired for a production and a producer, artistic company or independent artist.
The service contract is different from an employment contract for an employee. The designer is an independent service provider working on contract. There is no supervisor-subordinate relationship between the designer and the client. There are several ways to write a service contract. You should therefore adapt the template to each situation and, where necessary, comply with the applicable provisions of the Act respecting the professional status of artists in the visual arts, arts and crafts and literature, and their contracts with promoters (CQLR, c S-32.01), in particular sections 30 to 42. Once signed, the contract governs the contractual relationship between the parties thereto. It is therefore your responsibility to ensure that the contract reflects the agreement in place. To that end, it is recommended that you consult a legal advisor who is a member of the Quebec bar association. It should be noted that the person who signs the agreement on behalf of the producer must be authorized to do so by resolution of the board of directors.
